Ragging: Definition and Legal Provisions
As per Section 2(d) of the Act, ragging refers to any act—spoken, written, or physical—that causes mental or physical harm, humiliation, intimidation, or violation of human dignity of a student. This includes coercion, threats, wrongful restraint, confinement, or use of criminal force that exposes a student to ridicule, fear, or injury.
Prohibition of Ragging
Under Section 3, ragging is strictly prohibited within or outside educational institutions.
Punishment for Ragging
According to Section 5, any individual who directly or indirectly commits, abets, or propagates ragging shall be punished with:
Imprisonment up to two years, or
A fine up to ₹10,000, or
Both imprisonment and fine
As per Section 6, a student convicted under this Act shall be debarred from admission to any educational institution for up to five years.
Acts Constituting Ragging
Ragging includes, but is not limited to:
Teasing, abusing, or treating a student with rudeness
Rowdy or undisciplined behavior causing fear, distress, or harm
Forcing a student to perform acts causing shame or embarrassment
Disrupting academic activities of other students
Exploiting students for academic or personal tasks
Financial extortion or forced expenditure
Physical abuse including sexual misconduct, stripping, or lewd acts
Verbal, written, or online harassment and public humiliation
Any act affecting mental health, confidence, or self-esteem
AICTE-Prescribed Actions Against Ragging
To ensure strict enforcement, AICTE mandates exemplary and deterrent punishments, including:
Cancellation of admission
Suspension from classes or hostel
Withholding scholarships, results, or examination privileges
Debarring from institutional representation
Rustication for 1 to 4 semesters
Expulsion from the institution
Fine up to ₹25,000
Filing of FIR in every ragging incident without exception
Collective punishment if offenders are not identified
Institutions are required to immediately report ragging incidents and actions taken to the concerned authorities. Courts are urged to prioritize ragging cases to reinforce zero tolerance.
Zero Tolerance Policy
Ragging is a serious criminal offence.
